Fieldstar Terms of Service

1. Acceptance of Terms

By accessing or using Fieldstar, you agree to these Terms of Service. If you use Fieldstar on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Fieldstar™ is a trademark product developed by Squincy Sdn Bhd. References to Fieldstar include the Fieldstar platform, web application, mobile applications, Android app, software, services, and related materials.

2. User Accounts and Responsibilities

Users are responsible for maintaining accurate account information, protecting login credentials, and using Fieldstar only for authorized business purposes. You must promptly notify us or your organization administrator of suspected unauthorized access or security incidents.

• Use Fieldstar in compliance with applicable laws, policies, and contracts.
• Ensure submitted data, files, photos, location records, and job information are accurate and lawful.
• Obtain required permissions, notices, and consents from employees, contractors, customers, or field users where applicable.
• Do not share accounts, bypass security controls, or use another user's credentials.

3. Subscriptions, Billing, and Payment

Fieldstar may be offered under paid subscriptions, enterprise agreements, usage plans, pilot arrangements, or app-enabled service packages. Fees, billing cycles, renewal terms, taxes, and payment methods are described in the applicable order form, quotation, invoice, subscription page, or written agreement.

• Subscription fees are generally non-refundable unless required by law or stated in a separate agreement.
• Late, failed, or disputed payments may result in restricted access, suspension, or termination.
• Plan features, limits, pricing, and availability may change with notice where required.
• Customers are responsible for taxes, duties, bank charges, and similar fees unless stated otherwise.

4. Acceptable Use

You may not use Fieldstar in a way that harms the service, other users, customers, third parties, or applicable legal obligations. Prohibited activity includes:

• Uploading unlawful, infringing, harmful, deceptive, discriminatory, or malicious content.
• Attempting to access systems, accounts, data, or functionality without authorization.
• Reverse engineering, scraping, probing, overloading, disrupting, or bypassing security controls.
• Using Fieldstar to transmit malware, spam, abusive messages, or unauthorized tracking.
• Misrepresenting identity, employment status, job activity, attendance, or operational records.

5. Data Ownership and Customer Content

Customers retain ownership of data, records, files, photos, job details, employee information, customer information, and other content submitted to Fieldstar by or on behalf of the customer. Squincy Sdn Bhd receives a limited right to process customer content only as needed to provide, secure, support, improve, and maintain Fieldstar.

Customers are responsible for the legality, accuracy, quality, and authorization of content they submit or cause to be submitted through the service.

6. Confidentiality

Each party may receive confidential business, technical, product, pricing, operational, workforce, or customer information. The receiving party must use reasonable care to protect confidential information and may use it only for purposes related to Fieldstar, unless disclosure is required by law or authorized in writing.

7. Intellectual Property

Squincy Sdn Bhd and its licensors retain all rights, title, and interest in Fieldstar, including software, interfaces, workflows, designs, documentation, trademarks, trade names, logos, technology, and related intellectual property. These terms do not transfer ownership of Fieldstar to any customer or user.

Feedback, suggestions, or improvement ideas may be used by Squincy Sdn Bhd without restriction or obligation, provided we do not disclose confidential customer information in violation of these terms.

8. Mobile App Usage

The Fieldstar mobile app may use device capabilities such as location, camera, notifications, storage, and network access to provide field operation features. Users are responsible for granting only the permissions they are authorized to grant. Some features may not work if required permissions are disabled.

App store terms, mobile network charges, operating system requirements, and device restrictions may also apply to mobile app usage.

9. Third-Party Integrations

Fieldstar may integrate with third-party services such as maps, messaging, identity providers, analytics, payment processors, cloud infrastructure, customer systems, and business applications. Third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party services outside our control, but we work to use reputable providers and appropriate integration practices.

10. Service Availability and Changes

We aim to provide reliable service, but Fieldstar may be unavailable from time to time due to maintenance, updates, outages, security events, third-party provider issues, network failures, or circumstances beyond our reasonable control.

We may modify, improve, suspend, or discontinue features to maintain security, performance, compliance, product quality, or business needs. Where practical, we will provide notice of material changes affecting subscribed customers.

11. Suspension and Termination

We may suspend or terminate access to Fieldstar if a user or customer violates these terms, fails to pay fees, creates security or legal risk, misuses the service, or if continued access may harm Fieldstar, customers, users, or third parties.

Upon termination, access to the service may end and data may be retained, exported, deleted, or archived according to the applicable agreement, product settings, legal requirements, and our retention practices.

12. Warranty Disclaimer

Fieldstar is provided on an "as is" and "as available" basis unless a separate written agreement states otherwise. To the maximum extent permitted by law, Squincy Sdn Bhd disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

13. Limitation of Liability

To the maximum extent permitted by law, Squincy Sdn Bhd will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, business opportunity, or operational interruption arising from or related to Fieldstar.

Where liability cannot be excluded, our total liability will be limited to the amount paid for the affected service during the period specified in the applicable agreement, or the minimum amount permitted by law.

14. Indemnity

Customers agree to defend and indemnify Squincy Sdn Bhd from claims, damages, liabilities, costs, and expenses arising from customer content, unauthorized use, violation of these terms, breach of law, or failure to obtain required permissions and consents from users, employees, contractors, or third parties.

15. Governing Law

These terms are governed by the laws of Malaysia, unless a separate written agreement specifies another governing law. Courts or dispute resolution forums located in Malaysia will have jurisdiction, subject to any mandatory legal requirements or written agreement between the parties.

16. Updates to these Terms

We may update these Terms of Service from time to time to reflect product changes, legal requirements, security needs, or business practices. The latest version will be posted on this page with an updated date. Continued use of Fieldstar after the effective date means you accept the updated terms.
